The international community has endeavored to organize legal rules that define the types of international crimes and how to punish their perpetrators, including, of course, war crimes, which were supported by the principle of non-statutory limitation.

The reason why the statute of limitations does not apply to war crimes is because it is difficult to file lawsuits immediately after they have been committed.

This principle is not useful unless the national legislation allows it to be implemented.

Therefore, states undertake to include this principle in their legislation, while recognizing universal jurisdiction for the benefit of national courts to prosecute and punish perpetrators.

Our study aims at defining the concept of war crimes and identifying the principle of non-prescription in international criminal law
