African ragional organization recently has experienced a noticeable delay in setting up a judicial body compared to its counterparts at the European and American ragional levels.

However the development and progress achieved by the judicial system within the framework of the African Union, in the theory, is a great achievement and an important step, compared to the practice this body still faces great challenges that require a political will of the leaders of African countries in order to activate and give it a real opportunity to play the aspired role for which it was created.
