The protection of human rights is the main essence in the establishment of the theory of diplomatic protection, since human rights are its goal, and therefore the embodiment of that theory was linked to the claim of international responsibility because most of the practical cases of diplomatic protection arose as a result of states’ violation of the rights of foreigners residing on their territory, which resulted in the acquisition of the state to which he belongs.

the aggrieved party has the right to sue the state causing the harm, since the individual does not have sufficient international legal capacity that grants him the right to initiate the lawsuit himself.

therefore, diplomatic protection contributed to activating the protection of the individual judicially at the international level.
