أصبحت فلسطين دولة غير عضو في منظمة الأمم المتحدة سنة 2012 كما انضمت للمحكمة الجنائية الدولية في 2015، و بعد دراسة أولية من 2015 إلى 2019 قررت المدعية العامة طلب إصدار قرار بشأن الاختصاص الإقليمي للمحكمة في حالة فلسطين، و التي أصدرت قرارها في 05 فيفري 2021، جاء فيه أن طلب الإدعاء كان ضروريا وأنه يتوافق و النظام الأساسي، وأن فلسطين دولة عضو في المحكمة الجنائية الدولية وقع على إقليمها السلوك المعني، كما أكدت المحكمة اختصاصها الإقليمي على الأراضي الفلسطينية المحتلة وفقا لخطوط ما قبل سنة 1976، وأن اتفاقيات أوسلو لا تحد من تفويض فلسطين للمحكمة لتعارض ذلك و حق الشعوب في تقرير مصيرها

After a preliminary study, the Prosecutor decided to request a decision on the territorial jurisdiction in the case of Palestine, which issued it decision on 2021, and stating That the prosecution's request was necessary, and Palestine is a member state of the I.

C on the territory of which the conduct in question occurred, also the Court affirmed its territorial jurisdiction over the occupied Palestinian territories according to pre-1976 lines, and that the Oslo Accords do not limit Palestine's mandate to the Court.
