Abstract EN
The new Algerian regulations governing the public service delegation agreement made the attribution of the latter subject to the universal principles of public procurement.
This concerns the principle of equal treatment of candidates, the transparency of selection procedures and freedom of access.
This is in contracts traditionally concluded according to the intuitu personae.
Thus, we will elucidate the mechanisms for implementing the principles of public procurement, in the light of Algerian law and more specifically, executive decree 18-199 relating to the delegation of public service, while reconciling with the intuitu personae as a selection criterion.
