This study tends to present a cognitive and systematic comparison of the structure of the moral philosophy of the modern state between two masters of arab and western thought alike in the modern and contemporary era, beginning with the algerian thinker malik bennabi - may god have mercy on him, and finally bael hallaq, this study assumes tha the modern state is a western european product that is based on western modernity narratives and thus differs - radically - from what is prevalent in islamic literature, specifically in the ethical anchor, and the study also considers that malik bennabi and wael hallaq concluded the modern state's moral impotence in view of its appeal to the reference of western modernist thought therefore, judging by the failure of its applications in our arab and islamic environment in view of the difference in the authority of governance and moral philosophy.
