Abstract EN

The magnificence of Islamic jurisprudence (fiqh) is evident in its accompaniment to events and crisis, no matter how great they are, jurisprudence rues are one of its pillars that constitute one of its fertile materials that can imbibition such kind of events and crisis.

this research clearly explains, through the applying of two main rules named “neither harm nor harmful and hardship brings convenience” with their branches, for supporting the precautionary measures taken by the countries, especially the kingdom of Saudi Arabia, to prevent the outbreak of new corona virus (covid-19) that declared by who as a global pandemic.

“neither harm nor harmful” rule and its related branches imbibition the strict precautionary measures taken to prevent and limit the outbreak of covid-19 epidemic, including the imposition of penalties for violators to award off major and general bad works, while the rule of hardship brings convenience with its related branches support supporting the precautionary measures concerning the suspension of certain acts of worships and religious duties such as the temporary suspension of the daily fives prayers and Friday prayers in groups.

this is by facilitating the tolerant sharia and rising the embarrassment of the nations, these rules also applied to the measures that are accompanied by firm precautionary measures that mitigate the effects of their application to the extent that considers the humanitarian and living necessities.

to keep the ruling on its origin before the pandemic coinciding with the decreasing risk and a gradual return to normal life according to what is decided by the most brutal experience of the prudential authorities.

the precautionary measures came compatible with the basic law of governance and the theory of exceptional circumstances for jurists as one of the theories branching from the principle of legality.

the study has recommended more jurisprudential care of this crisis and similar kind of epidemics, we ask Allah for well-being and safety, as establishing a research center for medical jurisprudence that includes researchers and experts from jurists, doctors and lawyers to study the events and medical crisis and the establishment of a scientific chair to study the jurisprudence and sharia implications of the new epidemic of covid-19 with further studies.
