Abstract EN

The first part of this research was divided into two separate sections.

The first section discussed the topic of urgent matter, where it was found that all definitions, despite their difference, agree that the urgent matter is the decision of the Court to resolve the dispute in an urgent manner without affecting to the origin of the right.

Then, it the researcher discussed the reasons that urged the legislation to regulate the expedited judiciary, in addition to exploring the historical development of the emergence of urgent judiciary.

The second section is divided into two parts.

The first part sought to identify the similarities between state order and urgent order; whereas the second part dealt with the differences between state order and urgent order.

The researcher also explained the confusion that some have between state order and urgent order because they aim to issue a temporary decision in an urgent manner without affecting to the origin of the right, but they are different in various aspects such as methods of appeal and issuance procedures.

This makes each of them a special system of a special legal nature.

The research ended with a set of conclusions and recommendations under the theme.
