Abstract EN

The FATF had imposed on states, through the provisions of its recommendations, the implementation of the targeted financial sanctions in accordance with the relevant Security Council resolutions which are related to the prevention and suppression of terrorism, terrorist financing and the proliferation of arms.

Those resolutions oblige states to freeze the funds of any person or entity or other assets, and to ensure that no money or other assets are made available, directly or indirectly, to any person or entity, for himself or for his beneficiaries.

The UAE legislator has mandated on financial institutions and designated non-financial businesses and professions, and on every natural or legal person to adhere immediately to the instructions issued by the relevant authority in the country regarding the implementation of these resolutions, and imposed criminal offence against the violation of these instruction.

This study deals with the relevant Security Council resolutions, and the obligations imposed by the UAE legislator, in addition to the criminal responsibility for violating instructions regarding the implementation of those resolutions.
