Abstract EN

Under the principle of universal criminal jurisdiction, the national judiciary recognizes the prosecution of criminals for acts committed outside the territory of the state, by initiating criminal charges against them.

The principle of universal criminal jurisdiction is: “a principle according to which an internal criminal judge is entitled to exercise his or her judicial powers against an accused or criminal offender: war or crimes against humanity, regardless of where they were committed, the nationality of the accused or the nationality of the victims.” The principle of universal criminal jurisdiction originates in treaty and customary international law, whereby it confers upon the state general jurisdiction to criminalize and punish certain acts reprehensible by the international community as a whole, in view of the harm they cause for human interests.

These include: crimes of terrorism, war crimes, crimes against humanity, crimes of genocide, crimes of human trafficking, the crime of aggression, and the acts of piracy.

The national judiciary applies its jurisdiction to crimes that were not committed against its territory and its people.

It is concerned with the defense of interests and values of a global dimension.
