This study aims to define the scope of the contractual liability of the owner for damage caused by buildings in Algerian law ; either as a seller (ordinary seller or real estate developer) or as a lessor.

and in all cases, the liability of the owner of the buildings will be committed in the event of breach of its contractual obligations, those which appear among the requirements of contracts in which the buildings are considered to be the subject of them, such as the building sale contract or the real estate development contract or real estate lease or the obligations agreed within the framework of these contracts, all within the framework of the conditions and legal bases fixed by the Algerian legislator.
