The difficulty of finding a definition of this motion takes the consensus of doctrine for many reasons, the plurality of its cases and facts that establish it, is one of them, in addition this motion was not known in the privious civil procedure law, it has been introduced in the new civil and administrative procedural law according to jurisprudence of superme court, but the legislator did not show all its dispositons and there effects.
