استحدث المشرع الجزائري بموجب الأمر رقم 15/02 المؤرخ في 23 جويلية 2015 المعدل لقانون الإجراءات الجزائية آليات جديدة في إطار إصلاح العدالة؛ من بين هذه الآليات نظام الأمر الجزائي الذي يعد وسيلة لتحقيق العدالة الجنائية بطريقة أسرع من خلال التسريع في إجراءات التقاضي، و إن كان هذا يشكل خاصية إيجابية إلا أنه في المقابل يمس بأهم مبادئ المحاكمة الجنائية العادلة و التي من أبرزها الحق في الدفاع و ما يخوله هذا الأخير من ضمانات أساسية من مناقشة و مواجهة بين الأطراف، في إطار ذلك سيتم من خلال هذا المقال البحث في مدى تأثير الأمر الجزائي على الحق في الدفاع
Abstract EN
The Algerian legislator has been renewed according to the order N° 02/15 in the date of 23rd July 2005 the modified and which is continued to the new measures of criminal law through to the framework of justice.
The system of criminal order is one of these framework which is a another way of the republic claim it is also a measure to make a judicial justice and this has positive side as lets the judiciary more facilitator and more faster.
However it also has a negative side it touches the most serious branch of fair judicial trial which is the right of defense and this later puts fundamental guarantees like discussion and facing among the sides.
We will discuss in this report the influences of the criminal order on the right of defence.
