The principle of "compulsory force" is already established in contracts, which is demonstrated in article 106 of the Civil Code and in article 63 of Law 90/11 on the Labor Relations Law, but the specific nature of the employment contract imposes exceptions to this principle due to a possible modification by the employer alone and this for various justifications linked to the survival of the institution, and this is what the Algerian legislator has attempted to reconcile under the general and special provisions of labor law.
