حرصا منها على ترشيد الوظيفة الإدارية و الحفاظ على أخلاقيات الخدمة العمومية، تدعمت الجزائر مؤخرا و بمقتضى المرسوم الرئاسي رقم 20ـ45 بمكسب قانوني هام تمثل في إعادة تأسيس هيئة وسيط الجمهورية من أجل المساهمة في حماية حقوق المواطنين وحرياتهم اتجاه الإدارة وفي تكريس قانونية سير المؤسسات و الإدارات العمومية، بعدما تم تكريسه سابقا على ضوء المرسوم الرئاسي رقم 96/113 الملغى، على أساس أن الوسيط الوحيد هو القانون، و هو ما سنعالجه ضمن مباحث ثلاث ابتداء من إبراز الطبيعة غير المستقلة لإطارها التأسيسي، و البحث في الضمانات القانونية للهيئة، بالإضافة إلى تحديد مدى فعاليتها على المستوى الوظيفي، وصولا إلى تحديد الاقتراحات و البدائل الكفيلة بتعزيز الهيئة و الارتقاء بها
Abstract EN
In order to preserve the ethics of the public service, Algeria has been strengthened by significant legal gains represented in the re-establishment of the Mediators Committee in order to contribute to protecting the rights and freedoms of citizens towards the administration, according to Presidential Decree No.
20-45, after its abolition previously in light of Presidential Decree No.
96/113, which we will address in three subjects, by highlighting the non-independent nature of its founding framework, in addition to its lack of legal guarantees, and its limited effectiveness at the functional level.
