The normal leasing of the Waqf is considered one of the most important actions that apply to the Waqf as a stand alone system, in order to ensure its survival, continuity and lasting benefit, and to make it a permanent financial resource covering various expenses, and an effective tool to address many of the economic and social problems that societies suffer from, so the Malikiyah jurists are given this contract a great care, and they singled it out with terms and conditions that distinguish it from other contracts, in order to preserve it due to its prominent role in the waqf investment, and in order to achieve its goals entrusted to it, and this is what the Algerian legislator restricted through the conduct of the contract “ normal leasing of the waqf ” with defines jurisprudence rules In the form of a legal system, most of its rulings are due to Islamic jurisprudence in general, and Maliki in particular.
