تكتسي الصفقات العمومية أهمية كبيرة لدى المشرع الجزائري، بالنظر إلى المركز الذي تحتله باعتبارها الوسيلة التي تستخدم من طرف الدولة لتنفيذ برامجها و كذا صرف أموالها، حيث لم يكتف المشرع بإقرار حماية لها من خلال التنظيم المتعلق بها، و إنما أقر حماية بموجب نصوص قانونية أخرى و هذا بهدف ضمان الرقابة و التحكم في الإنفاق العام، فهي أكثر المجالات التي ترتكب فيها جرائم الفساد، هذا ما يؤدي إلى النوعية السيئة للأشغال و الخدمات ي إطار الصفقة و إلحاق الضرر بخزينة الدولة، و من ثم وجب حماية الصفقات العمومية لتحقيق نجاعة الطلب العمومي و الحفاظ على المال العمومي
Abstract EN
Public transactions are of great importance to the Algerian legislator, given the position it occupies as the means used by the state to implement its programs as well as the disbursement of its funds.
Oversight and control of public spending, as it is the most common area in which corruption crimes are committed This leads to the poor quality of the works and services provided within the framework of the deal and damages the state treasuryTherefore, public deals must be protected to achieve the efficiency of public demand and preserve public money.
