Abstract EN

Islamic Maghreb saw a constitution of many Communities starting from 2 century AH/ 8 century AD.

These Communities varied among Jurisprudence Communities as Hanefite and Malikite as well theological political Communities such Ibadi and Shiite.

Each community tried to dominate Meghreb, but in the late 5 century AH/ 11 century AD, The Malikite was the dominant one.

The Islamic Communities situation in Malikite Fiqh differed from Jurisprudence Communities and theological political Communities, we find ence of Jurisprudence Communities whereas we find a big concentration on theological political Communities who seem in a non-fixed situation.

Some scholars classified them as Muslims and the others put them out of Islam, but there was a contract to the Sunna.

This contract led to give a hard judgment which helped to change the religious social structure which was followed by Maghreb.
