يتناول المقال بالبحث و الاستقراء الأحكام الفقهية و القانونية التي ترد على الطلاق في مرض الموت، حيث خلصت إلى أن فقهاء الشريعة و القضاء الجزائري، قد أقروا بالإرث للزوجة في حال الطلاق، و أقروا أيضا بجواز خلع المرأة المريضة لزوجها، بقدر ميراثه منها أو أقل، كما يجوز خلعها منه و هو مريض، مع الإشارة إلى و باء (كوفيد 19) و تكييفه الفقهي
Abstract EN
The following article sheds the lights on the legal provisions of the algerian législature as well s thé jurisprudence concerning the divorce in the case of death.
Both have recognized the inheritance of the wife in the event of divorce, ad the permissibility of the sick woman to divorce her husband, as much or less as his inheritance from her.
It is also permissible to remove her from him in case of husband's sickness.
The challenge is to consider the ongoing epidemy (Covid 19) as a legal motive for divorce
