يمكن أن يمس الإجراء القضائي عيب جوهري سواء في شروطه الشكلية أو الموضوعية الموجبة لصحته، و هو ما قد يؤدي إلى الحكم ببطلانه نتيجة لتمسك الخصم بهذا البطلان أو إثارة المحكمة له من تلقاء نفسها، و من ثمة خسارة رافع الدعوى لدعواه، لسبب كان بإمكانه تصحيحه أثناء سير الخصومة.
و هو الأمر الذي عالجه قانون الإجراءات المدنية و الإدارية ضمن نص المواد 60 إلى 66 منه، و التي تكون موضوع الدراسة.

The judicial process could be fundamentally defected, whether in its formal or substantive conditions for its validity.
which may lead to be invalidated as a result of the opponent's adherence to this invalidity, or raised by the court on its own.
thus the appellant will lose his lawsuit for a reason he could have correct pendent lite, and that's the matter has addressed by the administrative and civil procedural law in the text of articles 60 to 66 thereof.
which is the subject of this study.
