Abstract EN

The rapid development of the technological and informational field, in addition to making progress and facilitating many areas of life, has had a negative impact on individuals and societies as a result of the immoral and legal exploitation of these technological means, which led to the emergence of a new type of crime that differs from traditional crime, which is the so-called crimes of information or cyber-crime.

In this research paper, we discuss the impact of cybercrime on individual rights and freedoms by choosing Algeria as a model, through exposure to the conceptual framework of cybercrime, where we refer to the definition of cybercrime and its types and characteristics that distinguish it from the rest of traditional crimes, then we address the impact of cybercrime on rights and freedoms Individualism, as well as the impact that the fight against this type of crime has on the private lives of individuals, without losing sight of the legal system of the Algerian legislator and field mechanisms to combat these crimes through the provisions of the Algerian law.

At the end of our research, we concluded that combating cyber-crimes in Algerian legislation is considered a relatively recent matter through the laws enacted by the Algerian legislator in this field, such as Law No.

09-04, which includes special rules for the prevention and control of crimes related to information and communication technologies, or the amendments to the Algerian Penal Code under the two laws 23-06-04-15, however, the legal system in the Algerian legislation is still insufficient to frame this process to ensure the protection of the private rights and liberties of individuals, given the negative effects on the latter as a result of the interest and safety of the state being given priority over private individual liberties.
