The protection of plant varieties is one of the developments that have emerged on the international scene, especially with the emergence of many innovations in this important field directly related to human life.

Therefore, the comparative law tended to recognize the intellectual property rights contained in the new plant varieties but without agreeing to a unified system of protection.

That is why we will try, through this research paper, to study the system of plant tenure protection in Algerian law, by explaining the various international regulation that exist, after which we will address the position of the Algerian legislator by examining the conditions and implications of protecting the new plant varieties.
