يمكن للمتعاملين الاقتصاديين في قانون الصفقات العمومية الترشح لصفقة في شكل تجمع مؤقت للمؤسسات.
خصصنا هذا المقال لتوضيح المقصود بهذا النوع من التجمعات والمزايا التي يمنحها للصة الصغيرة والمتوسطة.
واستخلصنا أن التجمع المؤقت ينشأ عن عقد ذو طابع تعاوني مؤقت يقوم على الاعتبار الشخصي ولا يتمتع بالشخصية المعنوية.
كما أنه يوفر للمؤسسات فرصة جمع قدراتها المالية والبشرية والفنية لتقديم عروض والفوز بصفقة عمومية وتنفيذها.
اللجوء لهذا النوع من التجمعات مقيد بعدم الإضرار بالمنافسة، ولقد تضمن قانون المنافسة أحكام تفضيلية للمؤسسات الصغيرة والمتوسطة التي تتجمع في شكل تجمع مؤقت مما يؤدي إلى ترقية مركزها في السوق وضمان استدامتها.
Abstract EN
Economic operators have the rights to run for a public transaction in the form a temporary grouping of enterprises.
it emerges from a temporary cooperative contract that does not have a moral personality.
due to this grouping emerging companies can gather their financial and human abilities in order to be able to run for a public transaction, win it and execute it.in addition, the competition law includes preferential provisions for small and medium enterprises that start-up, can benefit from when creating a temporary gathering to upgrade their position in the market and to ensure their sustainability.
