Digital transactions are playing an important role in world trade, is worked to bring the distances closer and remove all kinds of barriers, but the real problem in the field of E-commerce and the use of information methods in general is the problem of proof, the laws regulating evidence have become limited to regulating electronic proof issues in the field of transactions and contracts.

we find that the Algerian legislator has addressed this by deciding the provisions of electronic evidence under law no: 05-10 related to the amendment of the civil code, including recognizing the authenticity of electronic writing and signature for the first time, these are new forms of evidence that guarantee the protection of the rights and freedoms of dealers in the digital field.
