تهدف هذه الورقة لرصد المركز القانوني لقرينة البراءة من خلال إصلاح محكمة الجنايات بموجب القانون رقم: 17/07؛ حيث تم التطرق في البداية إلى طبيعة المركز الذي تحتله قرينة البراءة في الأنظمة الجزائية المعاصرة، ثم عرض ملامح الإصلاح التشريعي الذي مس محكمة الجنايات، وقد تبين بعد البحث في مكونات هذا الإصلاح وجود جوانب إيجابية تسهم في تعزيز قرينة البراءة كضمانة أساسية للمحاكمة العادلة، لاسيما ما يتعلق بتوسيع تشكيلة المحكمة، تسبيب الأحكام و احترام مبدأ التقاضي على درجتين.
غير أن التأمل العميق في تلك الجوانب الإيجابية يفصح عن وجود إشكالات عميقة تؤثر على مركزية قرينة البراءة؛ أهمها ما يتعلق بنظام المحلفين و البنية الإجرائية لتكريس مبدأ التقاضي على درجتين، وقد خلصت الدراسة إلى نتائج و اقتراحات تهدف إلى تعزيز جودة المحاكمة الجزائية الوطنية تشريعا و ممارسة
Abstract EN
This paper aims to monitor the legal status of the presumption of innocence through the reform of the Criminal Court under Act No.
1: 17/07; The nature of the status of the presumption of innocence was first addressed in contemporary penal regulations, and the features of the legislative reform that affected the Criminal Court were presented.
As a result of consideration of the components of the reform, there were positive aspects that contributed to strengthening the presumption of innocence as a fundamental guarantee of a fair trial.
However, deep reflection on those positive aspects reveals deep-seated problems affecting the centrality of the presumption of innocence.
