This study aims to shed light on the powers of the contracting authority at the stage of implementing the public deal.

The administration, as a contracting party, enjoys a set of privileges in accordance with general principles even if they were not stipulated in the legislation.

The Presidential Decree 15-247 came to strengthen the powers of the contracting authority in public procurement contracts.

Whether the order is related to its authority to supervise and direct or to amend and impose penalties during the implementation of the deal, this is not arbitrary and exploitative for the client contracting with it, but rather in order to achieve the public interest and what is required by the regular process of the public utility.
