Abstract EN

This study aims to shed light on an important issue in the marital relationship, represented in the independence of the wife's financial liability and how the Algerian legislator handled it, in both the family law and the penal code.

Moreover, as this topic is of a paramount importance in running financial family relations, in particular, the Algerian legislator does not only recognize the wife's financial independence, but also emphasizes her full capacity and her complete freedom to dispose of her money.

However, real life practices have compelled the legislator to criminalize acts of coercion and intimidation, which usually result in the husband's seizure of his wife's property, and thus consider this act a misdemeanor that deserves punishment.
