Abstract EN

The Algerian legislator has adopted the double degree principle of jurisdiction in view of criminal matter through a constitutional revision of 2016 and the law n° 17-07 modifying the code of penal proceeding.

this adopted principle is of particular nature, because of the problems raised within the criminal court, concerning its composition in the second degree of jurisdiction, as well as its judgments which isn’t conform to the composition of the criminal court of appeal, a such provisions, don’t reflect the veritable sense of double degree principle of jurisdiction.
