الاستعانة بالكفار لا تستلزم الولاء لهم، و لا تناقض البراءة منهم، مالم يقترن بها الركون إليهم و محبتهم، أهمية إدراك الفرق بين الموالاة المقيدة و الموالاة المطلقة، و التي يطلق عليها بعض العلماء: (التولي)، فالمقيدة: كبيرة من كبائر الذنوب، وهي محبتهم ومودتهم لغرض دنيوي مع بقاء أصل الإيمان في القلب، و المطلقة: مخرجة من الملة، و هي: المحبة التامة، و الذب و الدفاع عنهم، و نصرتهم على المسلمين، الشواهد التاريخية بجانب النصوص الشرعية تثبت حصول الاستعانة بالكفار على مدى العصور، سواء في السلم أو الحرب، لا خلاف في جواز الاستعانة بالكفار عند الحاجة، حال الأمن من مكرهم لغرض الحماية و منع الأذى، جمهور العلماء على جواز الاستعانة بالكفار في قتال غير المسلمين بشروط، بيان أوجه توفيق بعض العلماء بين ما ظاهره التعارض من النصوص الشرعية في مسألة الاستعانة بالكفار على قتال الكفار من حيث الجواز و المنع، أهمية إدراك الفوارق بين البغاة و الخوارج، و إبراز ما يختص بكل منهما؛ لئلا يقع الخلط بينهما في المعاملة و الأحكام، اشتراط جمهور علماء المذاهب الأربعة شروطا متفاوتة في جواز الاستعانة بالكفار في قتال المسلم المعتدي، الإجماع على أن مظاهرة الكفار و مناصرتهم على المسلمين بقصد ظهور الكفار عليهم و كسر شوكتهم كفر وردة عن الإسلام، من لم يجز الاستعانة بالكفار في القتال اختيارا لزمه إجازتها اضطرارا؛ بناء على قاعدة: "الضرورات تبيح المحظورات".
Abstract EN
Seeking help from the disbelievers does not require loyalty to them, and does not contradict disclaim them, unless it is accompanied by reliance on them and love them.
The importance of understanding the difference between restricted loyalty and olute loyalty, which some scholars call: () the restricted loyalty, is a great sin which means love them for a material purpose with faith and believe remaining in the heart, and the olute loyalty is a reason that causes Muslim disavows his religion, which is: complete love, defense and support them, and to wish them triumph over Muslims.
The historical evidence besides the legal texts proves the disbelievers seek help over the ages, whether in peace or war.
There is no dispute regarding the permissibility of seeking help from disbelievers when needed, In case of avoiding their cunning for the purpose of protection and preventing harm.
The majority of scholars agreed on the permissibility of seeking help from the disbelievers in fighting non-Muslims with conditions, presenting of some scholars success between what is the apparent contradiction from the legal texts in the issue of seeking the help of the disbelievers to fight the disbelievers in terms of permissibility and prevention, the importance of understanding the differences between the transgressors and the Khawarij (dissenters), and highlight what is relevant to each of them.
