Arbitration is an alternative means of resolving disputes, instead of resorting to the judiciary, organized by the Algerian legislator in the administrative and procedures law 08 / 09 from article 1006 to article 1062 in internal and international arbitration, highlighting the various aspects of interference by the will of the parties on the one hand, and the areas of judicial intervention in the arbitral proceedings on the other hand.

however, the Algerian legislator was not successful from several formal, procedural and objective aspects, in light of the lack of scrutiny of the legal terms used, and the conflicting provisions stipulated, especially in light of the reliance on the referral method, and leaving many of the issues governing the arbitral process without organizing it, which is which raises many practical problems.
