This research deals with the foundations upon which commercial transactions should be based in Islamic jurisprudence.

I have chosen the Saudi system as it is consistent with Islamic jurisprudence in its provisions.

It can be said that Islamic jurisprudence has succeeded in finding one theory, which is the theory of contract, that governs all transactions between people.

This theory is characterized by its ability to orb any commercial transaction that may occur in the future if it fulfills the legal conditions.

Moreover, Islamic jurisprudence has dealt with commercial businesses, such as purchase, partnership, mortgage and others, defining the provisions specific to each one individually.

Therefore, the method of Islamic jurisprudence is the most successful, because jurisprudence has created a single principle that governs all commercial business and from which the elements of commercial business are deduced, which are represented in the presence of two or more persons and the existence of an agreement.
