If a dispute occurs between the plaintiff and the defendant, and the plaintiff wants his case to be with the judge of his district and the defendant refused to do so, whose opinion is then taken in appointing the judge to adjudicate between them? The Hanafi jurists has different opinions on this issue, mentioned by Al-Hamawi in the treatise under investigation.

Al-Hamawi also quotes other fatwas and how they were received by scholars.

I have used two manuscripts of Al-Hamawi's treatise, both are in very good conditions.

The study derives its importance from its close relationship with the judiciary, and its handling of an issue that frequently occurs among people, related to the side of the lawsuit and the settlement of disputes.
