Arabic Abstract

جاءت هذه الدراسة لغرض تحقيق «غاية المرام فيما يتعلق بأنكحة الأنام» للإمام أحمد بن علي الديربي، من (محرمات النكاح) إلى (بيان الأنكحة الباطلة)، هدفت من وراء تحقيقه إلى إخراجه للناس و طلبة العلم الإفادة منه، و الاطلاع على ما جاء فيه من أحكام تتعلق بالنكاح في التشريع الإسلامي و بخاصة عند فقهاء الشافعية المتأخرين.

و قد تضمنت رسالتي فصلين أولهما دراسة عن سيرة هذا الإمام و نشأته وعلمه، و تحدثت كذلك عن الكتاب و صحة نسبته للمؤلف، ثم موضوعاته و ترتيبها، و منهج المؤلف فيه و مصادره، ثم نسخه الخطية و وصفها، و في الفصل الثاني حققت المخطوط تبعا لما هو معمول به عند المحققين ومناهجهم في ذلك، و كانت ثمرة هذين الفصلين أني توصلت إلى أن مؤلف هذه الرسالة أحد أعلام الفقه الشافعي، وأن هذا الكتاب أفرده مؤلفه لتعريف الناس بأحكام النكاح وما يتعلق بها، وأن محرمات النكاح يكن على التأبيد وغيره، وأن أركان النكاح تتمثل في الصيغة و الزوجة و الزوج، و أن هناك أنكحة باطلة لم يقرها الإسلام، و هي ما خالفت الأحكام الشرعية التي أقرتها الشريعة في نصوصها الغراء، كالشغار و المتعة و غيرهما، ثم ختمت بخاتمة بينت فيها أهم النتائج التي توصلت إليها.

English Abstract

Manuscript is a grand and glorious knowledge as it serves scholars and heritage.

It's a favor of Allah to pick me to serve this knowledge.

I was one of whom paticipating in in achieving • ng <

I aimed to deliver it to benefit people and students and see Al-Nikah canons of Islam that mentioned in it, especially for the Shafi scholars.

It included two chapters; the first is about Alemam and his origin and knowledge.

I also talked about the book and its relevance to the author, the topics and its order, the author's approach and his sources, and the book's hard copies and their descriptions.

In the second chapter, I achieved the manuscript depending on what researchers and their approaches.

By the end of those two chapters, I concluded that the author of this study is one of the masters of Shafi Figh.

And the book was written to define Al-Nikah canons and all about.

And the prohibitions of Al-Nikah apply to permanent and temporary types.

The pillars of Al-Nikah are formula, wife, guardian and two witnesses.

There are invalid types of Al-Nikah that weren't recognized in Islam.

These types violated the cannons recognized by the law of Islam in its obvious texts like Alshighar, Alovuties and so on.

Finally, I wish reward fit from the All-powerful and Protector to the reader and the writer.
