The phenomenon of torture did not know a specific history or a specific society, and it was not restricted to one nation without another, and it was practiced by backward peoples and civilized peoples equally.

As there were several indications that torture was legitimate for a long period of time, then it soon became one of the legitimate means of investigation to obtain evidence, as most regimes used it as a means of punishment.

The research studies the concept of the crime of torture and the difference between torture as an internal crime or torture as a crime against humanity, or torture and the meanings close to it such as cruel treatment or inhuman treatment, as well as studying the crime of torture in international criminal law and internal laws (Iraq, Egypt and France).
