Abstract EN

The search for a more effective and efficient guarantee to protect the credit granted by the creditor led to the emergence of a new idea in the field of guarantee, namely “unnamed guarantees”.

the importance of credit increased, however, there were many risks, including the debtor’s failure to pay the debt within the agreed deadlines.

this leads to the loss of the general security of the creditor, and as a result leads to a loss of confidence in transactions and the possibility of evading the performance of obligations owed to others.

hence, it was necessary to search for other means by which the creditor protects his debt against the risk of non-payment by the debtor requesting credit.

this paper deals with the issue of estimating the effectiveness of the role achieved by the privileged legal positions resulting from the corresponding debts.
