Abstract EN

Due to the fact that self-preservation is among the most important objectives that shariah aimsto maintain, and because medical mistakes became common among health-care providers, andfor the big number of questions raised by people in this regard, this study was conducted.

Thestudy aims to highlight the jurisprudential rules in terms of medical mistakes referring to theirroots, giving real-life related examples, and explaining the jurisprudential rules in this regard.

Theimportance of this study attributes to the importance of human soul in Islam, and to the fact thatmedical mistakes are spreading in our society in addition to the Importance of the jurisprudentialrules which form legal fundamentals to many related issues.

In addition to the inductive approach, the study followed the descriptive analytical approach, and concluded that there were a number ofjurisprudence rules on which many contemporary issues and approaches related to medical mistakescould be based, mostly related to the subject of inclusion.

Sharia has sought to preserve thehuman soul, and has never taken anything that would harm the respected human soul lightly, andIslamic law is a balanced protective religion.
