Arabic Abstract

الأصل في عقد الوكالة أنه غير لازم، فيحق لأي من المتعاقدين أنهاؤه دون تراض أو تقاضي، و لا ينقص من حق الموكل في إنهاء الوكالة أن تكون مأجورة، غير أنه يلزمه تعويض الوكيل عما لحقه من ضرر بسبب انهائها، كما يحق للوكيل التنحي عن الوكالة بإرادة المنفردة متى شاء، و لكن هذا الأمر لا بد أن يتم وفق ضوابط و شروط معينة أوجبها القانون، و إلا أصبح المخل بهذه الشروط عرضه لضمان التعويض عن الضرر الذي لحق الطرف الآخر جراء هذا الانهاء.

و قد ركز الباحث في هذه الدراسة على أسباب انتهاء عقد الوكالة و امتدادها في التشريع الأردني و القطري، حيث أن الغرض من الوكالة تنفيذ تصرف قانوني معين من قبل الوكيل نيابة عن الأصيل و هي بذلك عقد مستقل بحد ذاته عن التصرف القانوني المراد ابرامه بواسطتها، فإن ذلك يستتبع أن تنقضي الوكالة تبعاً لانقضاء التصرف بأبرامه أو تنقضي وحدها عما أريد اجراءه بواسطتها و هذا ما يسمى بالأسباب الخاصة لانتهاء عقد الوكالة، و بالرغم من عدم النص صراحة على حالات امتداد عقد الوكالة حاول الباحث جاهداً متكئاً على جهده المتواضع استنتاج حالات امتداد عقد الوكالة من بطون النصوص القانونية الناظمة لانتهاء عقد الوكالة، و استعرض الباحث في الفصل الأخير من الدراسة الآثار القانونية المترتبة على انهاء عقد الوكالة و تم عرض في نهاية الدراسة عدداً من النتائج و التوصيات.

English Abstract

Agency contract is non-mandatory, so that each party has the right to terminate it without compromise or cassation.

The mandator's right to terminate agency isn't affected by its being rented; however, he should compensate the agent for the loss resulting from terminating the contract.

The agent also has the right to waive agency by his own decision whenever he wishes; however, this should be done according to certain conditions and criteria determined by law, otherwise the violator should compensate the other party for the loss resulting from such a termination.

In this study, the researcher the reasons of terminating the agency contract as well as the extension of that in the Jordanian and Qatari legislations, in which the purpose of agency is to apply a certain legal procedure by the agent on the behalf of the original party.

In this vein, it is seen as an independent contract away from the legal action intended by establishing it, which entails that agency is terminated either by taking the action related to concluding it or terminated by its own regardless the action intended by it, referred to as the specific reasons for terminating the agency contract.

Despite the implicit stipulation concerning the cases of extending agency contract, the researcher did his efforts to conclude the cases of extending agency contract based on the content of the legal articles specifying the termination of the agency contract.

In the last chapter, the researcher addressed the legal implications for terminating the agency contract as well as the study results and recommendations.
