Arabic Abstract

يعد الإنسان وحقوقه الأساسية بضمنها الحق بالضمان الصحي محور اهتمام المشرع ومقصده، وأحدي اهم موضوعات الوثيقة الدستورية عبر مراحل تطوراتها المتدرجة حتى استوى هذا الحق على سوقه فنال الاعتراف الدولي باستقلاله.

وعلى قدر تنوع وتباين دوافع الاهتمام الدستوري بتكريس الحق بالضمان الصحي، تباينت الصياغات الدستورية لهذا الحق ومظاهره في الوثيقة الدستورية، فانصرف البحث إلى غاية مدارها استجلاء تلك الدوافع وتحري الفوارق في المعالجات الدستورية لهذا الحق عبر المقارنة بين طيف من الدساتير البرلمانية والاتحادية المناظرة لتجربتنا الدستورية في العراق قبل الولوج بيان موقف المشرع العراقي من هذا الحق وأليات تكريسه.

وبالاعتماد على منهج التحليل المقارن بين تلك الدساتير، جرى تقسيم البحث على مبحثين رئيسين، تصدى الأول منهما إلى التعريف بالضمان الصحي، وانصرف الثاني منهما إلى استعراض دوافع وصور التقنين الدستور للحق بالضمان الصحي حتى وصل البحث إلى نتيجة رئيسة مفادها أن الصياغة الدستورية لهذا الحق قد تنوعت استجابة لعوامل مجالها الاختلاف في فلسفة التشريع والظروف المحيطة به، والخبرة المتوافرة للمشرع، فاتجهت دساتير إلى النص الصريح والتفصيلي على الضمان الصحي، واتجهت دساتير أخرى إلى الإشارة المقتضبة والمرتبط بحقوق أخرى.

English Abstract

The human being and his basic rights, including the right to health insurance, are the focus and purpose of the legislator, and one of the most important topics of the constitutional document through the stages of its gradual development until this right leveled on its market and gained international recognition of its independence.

as varied and varied as the motives of the constitutional interest in dedicating the right to health insurance, the constitutional formulations of this right and its manifestations in the constitutional document varied.

before entering, a statement of the position of the Iraqi legislator on this right and the mechanisms for its consecration.

relying on the comparative analysis method between those constitutions, the research was divided into two main topics, the first of which addressed the definition of health insurance, and the second of them went to reviewing the motives and forms of constitutional legalization of the right to health insurance until the research reached a major conclusion that the constitutional formulation of this right varied.

in response to factors in the field of difference in the philosophy of legislation and the surrounding circumstances, and the experience available to the legislator, constitutions turned to the explicit and detailed text on health insurance, and other constitutions turned to the brief reference associated with other rights.
