Arabic Abstract

يعد الاستثمار محرك أساسي لتحقيق أغراض التنمية الاقتصادية، ولعل للاستثمار في الضمان الصحي الأثر الأكبر في تحقيق أهداف وأغراض التنمية الاقتصادية وتحقيق أهداف التنمية المستدامة بصوره مباشره، إذ يواجه القطاع الصحي في العراق تحديات هائلة، فقد عانى نظام الرعاية الصحية للمواطنين تدهورا كبيرا خاصة في ظل جائحة كورونا التي كشفت هشاشة النظام الصحي في العراق، مما أدى إلى ارتفاع معدلات الوفيات بين الرضع والأطفال والأمهات وكبار السن، وهذا التردي أدى إلى انخفاض معدلات العمر المأمول، ولاشك في أن معالجة هذه الآثار والنتائج سوف يستغرق وقتا طويلا، لذا سعت الجهات المختصة إلى إيجاد حلول قد تساهم في التخفيف من حالة التدهور ومن ضمنها قانون الضمان الصحي رقم 22 لسنة 2020، الذي يهدف في المادة (5) منه إلى تأمين التغطية الصحية الشاملة للشخص المضمون، وتقليل الأعباء المالية على المواطن والحد من الفقر، وتحسين جودة الخدمات الطبية المقدمة من خلال تنظيم العمل في القطاع العام والخاص والمنافسة في الخدمات الطبية، وتشجيع القطاع الخاص والاستثمار في مجال الخدمات الصحية.

وبالتأكيد أن الاستثمار مع شركات أجنبية تقدم خدمات صحية أو تقديم خدمة الضمان الصحي من الممكن أن يؤدي بأحد الأطراف أن يتلكأ أو يمتنع عن تنفيذ التزاماته سواء باتجاه علاقة الشخص المعنوي الأجنبي (شركة التأمين) مع المستفيد، أو العلاقة مع هيأة الرقابة الصحية المشار إليها بموجب هذا القانون، لذا يثار التساؤل حول القانون الواجب التطبيق على العلاقة العقدية بين الشخص المعنوي الأجنبي من جهة ومن جهة أخرى مع الطرف المستفيد (مواطن عراقي أو أجنبي مقيم أو زائر)، فمن الممكن أن يثار تساؤل أخر مفاده ما هي المحكمة المختصة في نظر النزاع، وهل بالإمكان اللجوء إلى الوسائل البديلة لحل النزاع مثل التحكيم الدولي أو التوفيق ضمن مراكز وهيئات التحكيم الدولية المعروفة.

English Abstract

Investment is a key driver for achieving the purposes of economic development, and perhaps investing in health insurance has the greatest impact in achieving the goals and objectives of economic development and achieving sustainable development goals directly, as the health sector in Iraq faces enormous challenges, as the health care system for citizens has suffered a major deterioration, especially in light of the pandemic.

corona, which revealed the fragility of the health system in Iraq, which led to high mortality rates among infants, children, mothers and the elderly, and this deterioration led to a decrease in the life expectancy rates, and there is no doubt that addressing these effects and results will take a long time, so the competent authorities sought to find solutions it may contribute to alleviating the deteriorating situation, including health insurance law no.

22 of 2020, which aims in article (5) to secure comprehensive health coverage for the insured person, reduce financial burdens on the citizen, reduce poverty, and improve the quality of medical services provided by organizing work in the public and private sectors and competition in medical services, and encourage the private sector and investment in the field of health services certainly, investing with foreign companies that provide health services or providing health insurance service may lead one of the parties to delay or refrain from implementing its obligations, whether towards the relationship of the foreign legal person (insurance company) with the beneficiary, or the relationship with the health control authority referred to hereunder.

the law, therefore, raises the question about the law applicable to the contractual relationship between the foreign legal person on the one hand and on the other hand with the beneficiary party (an Iraqi citizen, resident foreigner or visitor).

it is possible to resort to alternative means to resolve the dispute, such as international arbitration or conciliation within the well-known international arbitration centers and bodies.
