Arabic Abstract

تناولت هذه الدراسة اختيارات البلقيني في كتابه التدريب المخالفة للمذهب في كتب الزكاة و الحج و الصوم، و قد تضمنت ترجمة لحياته، و تعريفا بكتابه (التدريب الفقه الشافعي)، و تعريفا بمذهبه، و الألفاظ الدالة على اختياراته، كما بينت الدراسة مذاهب الأئمة الأربعة في هذه المسائل.

ومن أبرز ما توصلت إليه الدّراسة، أنّ البلقيني كان يصرح باختياراته في المسائل المخالفة للمذهب من خلال الألفاظ الخاصة بالترجيح في المذهب، أو من خلال دلالة السياق، وكذلك جمع بين الطريقتين (العراقيين و الخراسانيين)، و الانتخاب منهما و الترجيح بينهما، و إن كانت أغلبها على طريقة الخراسانيين، و كان له اختيارات لم تذكر في كتاب التدريب، و قد ذكر ابنه علم الدين في ترجمته لوالده بعضا من تلك الاختيارات.

English Abstract

This study dealt with Al-Balqini Selections in his book “Al-Tadreeb”, which are contrary to the doctrine as shown in the two books of “Al- Taharah”, “Zakat” and “, Fasting”, “Hajj”.

The study includes an antobiographical narration of the author’s life, an introduction to his book “Al – TadreebBelfiqh Al –Shafi’I”, “Al-Tadreeb on Al Shifi’I jurisprudence, an introduction to his doctrine and the vocabulary indicating to his selections.

In Addition, the study shows the doctrines of “the four Lmams” in such issues.

One of the prsmenat findings of the study is that Al- Balqini used to declare his selections in the issues which are contrary to the doctrine through weighting specific terms in the doctrine or through context connotations.

Another important finding of the study is that Al –Balqini combined the two methods of lraqis and Kharasaniyans weighted them and selected from both of them, selection was on the kharasaniyan way and there were other selections not mentioned in his book “Al-Tadreeb”, “Training”, his son cited some of which through his autobiographical narration about his father.
