Arabic Abstract

تلقي هذه الدراسة الضوء على موضوع يزداد الاهتمام به في كل أنحاء العالم و هو موضوع حماية حقوق الملكية الفكرية، و ذلك للأثر المباشر الذي تحدثه ظاهرة الحماية و من ثم التعدي على هذه الحقوق في اقتصاد الدول، و بشكل خاص مع التطور العالمي الهائل في الانتاج الفكري و الصناعي و التجاري، و السباق الأممي في تحصيل الريادة في مختلف هذه القطاعات.

تناولت الدراسة الدور المركزي لدائرة الجمارك الأردنية في حماية حقوق الملكية الفكرية و الصناعية عبر استعراض تطوير بنيتها التحتية و بنيتها التشريعية التزاماً من المملكة بالاتفاقيات و المعاهدات العالمية المبرمة في هذا الشأن و تحديداً اتفاقية التريبس.

و لأجل هذا الغرض تم التركيز على مفهوم الجمارك و مفهوم الحماية الحدودية، كما تم استعراض أهم الاتفاقيات الدولية المبرمة في هذا المجال، و سرد بنود التشريع الأردني العام المتعلق بحماية حقوق الملكية الفكرية و التشريع الجمركي المتعلق به، بعد ذكر الأصناف الخاضعة للحماية و صور الاعتداء عليها، لتخلص الدراسة إلى مواكبة التشريع الأردني للتشريعات العالمية و انسجامه مع بنود المعاهدات الدولية في حماية حقوق الملكية الفكرية و الصناعية، و لتقدم بعض التوصيات التي يتوقع منها أن تزيد من فاعلية دور السلطات الجمركية الأردنية في الحماية.

English Abstract

This study shed light on the topic of protecting intellectual property rights, which is increasing interest in all parts of the world, because of the direct impact of protection phenomenon and then encroachment to these rights in the economy of countries, especially with the tremendous global development in intellectual, industrial and commercial production, and the international race for obtaining leadership in all of these sectors.

The study dealt with the central role of the Jordanian Customs Department for protecting intellectual property rights by reviewing the development of its infrastructure and legislative structure, in compliance with the Kingdom's international agreements and treaties concluded in this regard, specifically, the TRIPS Agreement.

For this purpose, the focus was on the concept of customs and the concept of border protection, as well as reviewing the most important international agreements concluded in this field, and listing the provisions of the Jordanian general legislation related to the protection of intellectual property rights and the customs legislation related thereto, after mentioning the items subject to protection and the abuse the study concluded Keeping Jordanian law up to international laws and its consistency with the provisions of international treaties in the protection of intellectual and industrial property rights, and to present some recommendations that are expected to increase the effectiveness of the role of the Jordanian customs authorities in protecting.
