Arabic Abstract

إن تطوّر الحياة في مختلف جوانبها السياسية و الاقتصادية و الاجتماعية و العلمية ألقى بضلالة على الجانب القانوني المنظم لذلك التطوّر، و كان من نتيجة ذلك الأضرار التي تنتج عن استخدام الوسائل اللازمة لمواكبة ذلك التطور، و من هذا المنطلق بدأت المسؤولية المدنية عن الأضرار البيئية تحتل مكانا متميزا في مجال الدراسات و الأبحاث القانونية التي تعنى بموضوع البيئة، و حمايتها من التلوث.

ففي الواقع أنّ المسؤولية عن الأضرار البيئية تبدو معقدة و دقيقة، و يشوبها كثير من الغموض و الصعوبات، منها الصعوبات المتعلقة بأركان المسؤولية المدنية عن أضرار التلوث البيئي، المتمثلة بصعوبة تحديد الفعل الضار، و صعوبة تتعلق بالضرر و الصعوبة في العلاقة السببية بين الضرر و الفعل الضار، التي تشكّل حجر عثرة في مجال إصلاح الأضرار البيئية.

إضافة إلى ذلك صعوبة تتعلق في إقامة الدعوى، و أطراف الدعوى البيئية و أخيراً ما هي الأضرار القابلة للتّعويض عن أضرار التلوث؟ و كيفية شكل التعويض عن هذه الأضرار؟ و قد تناولت الدّراسة الوقوف على مختلف هذه الجوانب و الإشكاليات، إذ يُحِث في الأساس القانوني الذي يمكن للمتضرر الاستناد إليه ؛ للحصول على التعويض المناسب جرّاء ما لحق به من أضرار بيئيّة، و كذلك بُحِثَ في الدعوى البيئية، و الأثر المترتب عليه، و ذلك في إطار تحليلي مقارن بين القانون الأردني و القوانين الأخرى.

و قد خرجت الدراسة بنتائج عديدة من أهمها عدم كفاية القواعد العامة للمسؤولية المدنية للتطبيق على التلوث البيئي، و من أهم التوصيات التي خرجت بها الدراسة، ضرورة تعديل نصوص قانون حماية البيئة الأردني، و ذلك بإضافة نص خاص بالمسؤولية المدنية، و التعويض عنها في مجال الضرر البيئي، إلى جانب النّص على حق الجمعيات العاملة في مجال حماية البيئة، باعتبار أنّ لها صفة في رفع الدعوى.

English Abstract

That the development of life in its various political, economic, social and scientific aspects is more misleading on the legal aspect regulating that development and as a result of that damage resulting from the use of the necessary means to keep up with that development, and from this point of view the civil responsibility for environmental damage began It occupies a distinguished place in the field of legal studies and research that deals with the subject of the environment and protect it from pollution.

In fact, the responsibility for environmental damage seems complex، accurate and has a lot of ambiguity and difficulties, including difficulties related to the pillars of civil liability for environmental pollution damage، which is the difficulty of identifying harmful act, difficulty with damage and difficulty in the causal relationship between damage and the harmful act, which is a stumbling block in the field of environmental damage repair.

In addition, it is difficult to bring the case and the parties to the environmental action and finally what are the damages that can be compensated for the damages of pollution? And what is the form of compensation for these damages? This has been addressed by the study to identify various aspects and problems, where the legal basis on which the victim can rely to obtain appropriate compensation for the environmental damage, as well as research was done in the environmental suit and its impact, in a comparative analytical framework between For Jordanian law and other laws.This study produced many results; One of the most important recommendations of the study is the inadequacy of the general rules of civil responsibility to apply to environmental pollution.

The need to amend the provisions of the Jordanian Environmental Protection Act, by adding a provision for civil liability and compensation in the field of environmental damage, in addition to providing for the right of associations working in the field of environmental protection, as they have a characteristic in filing a lawsuit.
