Abstract EN

This research deals with the impact of the jurisprudence of priorities on the position of Islamic jurisprudence regarding the guardianship of the victorious Sultan, who conquered the people with his strength and thorns and took possession of the great imamate, without consultation from the nation or a significant allegiance.

The researcher was keen to shed light on the motives of the jurists on their position on the dominant sultan who usurped power by other than the legitimate way of allegiance to begin with.

Taking into account the priorities mentioned in this section.

The researcher dealt with this issue and the controversy in it, indicating its relationship to the jurisprudence of priorities, while linking it to the purposes of Sharia in terms of bringing benefits and warding off evils.
