Arabic Abstract

تتلخص دراستنا هذه في البحث في أحكام التحلل من عقد تأمين الحيات و كذلك التحلل من الإشتراك الإختياري في الضمان الإجتماعي في ظل القانون الأردني، فيما يخص عقد تأمين الحياة حيث يعتبر من العقود الطويلة الأجل لذلك قد يضطر المؤمن له التحلل من ذلك العقد أو إنهائه، و لذلك فقد منح المشرع في القانون المدني الأردني المؤمن له هذا الحق و لكن وفق ضوابط معينة إلا أنه تم الوقوف على بعض الثغرات في هذا القانون و من تلك الثغرات أن المشرع لم يبين ماذا يترتب على طلب المؤمن له إنهاء عقد تأمين الحياة أو التحلل منه سوى الاعفاء من الأقساط اللاحقة، لذلك تمخض عن هذا البحث التوصية بتعديل نص المادة الخاصة في إنهاء عقد تأمين الحياة في القانون المدني الأردني بما يخص حق المؤمن له في إسترداد الأقساط التي تم دفعها مسبقاً أسوة بالمشرع المصري.

أما عن إيقاف الإشتراك الإختياري في الضمان الإجتماعي فقد منح قانون الضمان الإجتماعي المؤمن عليه هذا الحق و لكن وفق ضوابط محددة نص عليها القانون، و من ضمن توصيات هذا البحث التوصية بالتوسع بما يُسمى بحالات صرف تعويض الدفعة الواحدة للمؤمن عليه في حال رغبته إيقاف الإشتراك الإختياري، و كذلك التوصية بتوضيح تفاصيل إيقاف الإشتراك الإختياري و آثاره على المؤمن عليه، و ذلك تشجيعاً للمشتركين و تلاقيا لأي غموض قد يواجه المؤمن عليه عند رغبته في إيقاف إشتراكه الإختياري.

English Abstract

This study is summarized in scrutinizing in the rules of disengagement from the life insurance contract and the optional subscription to the social security under the regulations of the Jordanian law.

In regard of the life insurance contract, which is considered as a long-term contract, the insured individual may find himself compelled to disengage himself from that contract or to terminate it.

Therefore, the law gave him this right within particular settings.

In this regard, some gaps are pointed out in this law, from these gaps ; the legislator clarified that the insured is not requested to pay the coming installments in case he terminates his contract, but the legislator did not clarify if there is any other right for the insured.

At the end of this study, it is recommended to amend the text of the private legal term to be similar to its counterpart in the Egyptian law which gives the insured the right to retrieve the installments which he paid previously.

According to the termination or stopping the optional subscription to the social security, the law gave the insured this right within particular regulations mentioned in the text of law.

Among the recommendations of the study, it is recommended to increase the cases of the onetime payment to the insured when he desires to terminate his optional subscription.

The study also recommends to clarify the details of the optional subscription and its impacts on the insured to pave the way in front of the participant to avoid any ambiguity face him when he decides to terminate his subscription.
