Arabic Abstract

تسلط هذه الدراسة الضوء على نطاق المسؤولية العقدية للصيدلي في القطاع الخاص، التي تكشف في محتواها عن خصوصية مسؤوليته القانونية عن غيره من اصحاب المهن، و تثير العديد من الاشكاليات انطلاقا من ايجاد نظام قانوني خاص ينهض على اساسه سائر متطلبات الحماية القانونية التي تحدد مسؤولية الصيدلي عند تقصيره بنشاطه المهني و تقدير التعويض العادل لمن يصيبه ضرر ناتج عن خطأ الصيدلي المهني.

و قد جاءت هذه الدراسة في فصلين، تضمن الفصل الاول الحديث عن تكييف مسؤولية الصيدلي و مدى مسؤوليته عن اخطاء معاونيه، فسيتم بحث اساس مسؤولية الصيدلي العقدية عما يصدر عنه من افعال اثناء ممارسته لمهنته متسببا بإضرار للغير مرتبا بذلك مسؤوليته عن اخطائه المهنية الشخصية، كما قد تقضي الحاجة او الضرورة الى الاستعانة بمساعدين لإنجاز بعض الاعمال فقد يرتكب المعاون خطأ اثناء انجازه للأعمال الموكلة اليه مما يرتب عليه اصابة المريض بضرر فتقوم مسؤولية الصيدلي عن اخطاء معاونيه، و قد تكون المسؤولية مشتركة بين الصيدلي و الشركة المصنعة للدواء التي تقوم في حالة عدم التزام الصيدلي و الشركة المصنعة للدواء عند بيع الدواء بالمواصفات و القواعد الناظمة لها اتجاه المريض مما يلحق به الضرر.

و يتناول الفصل الثاني البحث في اركان مسؤولية الصيدلي العقدية، و لقيام المسؤولية العقدية للصيدلي يجب ان يصدر منه خطأ اثناء قيامه بعمله وان ينتج عن هذا الاخير اضرار تصيب المريض وان تكون هذه الأضرار نتيجة مباشرة لخطأ الصيدلي وبناءا على ذلك تقوم مسؤوليته قبل المريض فيستحق التعويض.

English Abstract

The study shed light on the scope of pharmacist`s civil liability in the privet sector which reveals , in its content ,the privacy of his legal liability among other professionals .this study raises many problems starting from finding a specific legal system that other requirements of protection built on which identify the pharmacist`s responsibility when he did not do his vocational activity well and estimate the fair compensation to whom suffer from damage resulted from the pharmacist`s professional fault.

This study divided into two sections.

The first part talks about conditioning the pharmacist`s responsibility basis will be searched about what the pharmacist will do during practicing his job in the case in which he causes damage for others that he is responsible for his professional faults.

It is necessary to be supported by assistants to achieve some of activities.

It may be that the assistant makes a mistake during his work which will be resulted in hurting the patient.

Thus, the pharmacist should be responsible for the mistakes his assistants fall in also this responsibility should be cooperative jointly between the pharmacist and the manufacturer company of the medicine when they not commit in the characteristics and rules should both follow toward the patients who may be hurt.

The second chapter discusses the contractual rules of pharmacist`s responsibility.

To do the contractual rules of pharmacist`s responsibility, he should fall in a mistake during his work leading to hurt the patient, and these harms directly resulted from a mistake that the pharmacist falls in, based on this, he is responsible for the patient then the patient deserves compensation.
