Assuming the innocence of the accused and the preservation of his personal freedom from all aggression against it are rights guaranteed by constitutions to multiply their rulings, and therefore no authority has the right to take action that violates it, and that the right of the individual to freedom should be balanced against the right of the group to defend its vital interests, The right to presumption of innocence is considered a fixed principle related to the criminal charge in terms of proving it, and that the purpose of it is not to consider an incident committed by the crime fixed on the accused without evidence, so the legislator does not presume it, and that the concern to guarantee this right is the fulfillment of a constitutional obligation related to the formulation of public freedoms, and all of this falls under The policy of the constitutional legislator in protecting rights and freedoms.
