Arabic Abstract

تناولت هذه الدراسة الملحقات التي تندرج ضمن أحكام المبيع باعتبارها أحد أهم الجوانب في عقد البيع، لما يثور حولها من صعوبات في تحديدها بين طرفي العقد و قضاة الموضوع، لذا هدفت الدراسة إلى بيان مفهوم الملحقات وتمييزها عن المبيع ذاته و ما يشابهها من مصطلحات، و تناولت الأسس التي حددها المشرع الأردني في نصوص القانون المدني الأردني وخاصة نص المادة (490)، وتوضيح المقصود بما اتصل بالمبيع اتصال قرار و هو العقار بطبيعته وبيان تطبيقاته وتفريقه عن المنقول بطبيعته والمنقول بحسب المآل باعتبارهما لا يُعدان من الملحقات منفصلين، وبيَّنت هذه الدراسة أنَّ الملحقات القانونية من الدعاوي و الدفوع هي من ملحقات المبيع.

وتناولت الدراسة مفهوم ما أعد لاستعمال المبيع بصفة دائمة وهو العقار بالتخصيص و تفريقه عن المنقول بطبيعته و تكييفه القانوني وأحكامه متصلا ومنفصلا وشروط اعتباره وآثاره.

و وضحت الدراسة ماهية العرف و شروط اعتماده و دوره والقواعد الفقهية في تحديد ما يتبع المبيع بذكر وبدون ذكر و تطبيقات كل قاعدة.

و خلصت الدراسة إلى أنَّه لا بدَّ من توضيح الملحقات القانونية للمبيع بإضافة فقرة إلى المادة (490) من القانون المدني الأردني لكي تحدد هذه الملحقات باعتبارها ذات طبيعة قانونية خاصة وتشمل الدعاوى والدفوع التي تنتقل مع المبيع، و بيان المقصود بالعرف الذي يتحدد بموجبه ملحقات المبيع؛ لأنَّ النص ورد بالمطلق دون تحديد نوع العرف إن كان محليا أو مهنيا.

English Abstract

The study tackled the accessories that fall under the provisions of the sale as one of the most important elements in the contract of sale, because of the difficulties in defining it between the parties to the contract and the judges of the subject.

The study aims at explaining the concept of accessories and distinguish them from the sale itself and similar terms.

Fwrt thermoratchet study tackled Principles of the Jordanian legislator in the provisions of the Jordanian Civil Law, especially the text of Article (490), and clarifying the meaning of what connected to the sale decision connection, which is the nature of nature and the statement of its applications and disperse the movable by nature and movable by fate as they are not counted as separate accessories, of its claims and defenses are Sales extensions.

The study dealt with the concept of what has been prepared to be used permanently, which is the real estate by privatization and differentiating it from movable in nature and its legal adaptation and its provisions are connected and separated and the conditions of the consideration and effects.

The study clarified the nature of the custom, the conditions of its adoption, its role and the jurisprudential rules in determining what follows the sale by mentioning, without mentioning, and the applications of each rule.

The study concluded that the legal annexes to the sale must be clarified by adding a paragraph to Article 490 of the Jordanian Civil Law to define these annexes as being of a special legal nature, including the claims and defenses that go with the sale and the definition of the custom by which the attachments are to be determined.

The text responded categorically without specifying the type of custom, whether locally or professionally.
