English Abstract

The subject of this thesis is about additional evidence before the Court of Appeal in Jordanian law, as an exceptional route of the general origin that was planned by the Jordanian legislator in Article 185 of the Code of Civil Procedure.In order to achieve optimum results from this thesis, the topic has been divided into two chapters, the first of which dealt with the additional evidence ; its concept, its presentation and its formal controls ; and the second chapter dealt with its legality either before the Court of First Instance or before the courts of appeal and discrimination.

On the general provisions of the additional evidence The study concluded with many results and recommendations.

The most important of these was that the Jordanian legislator limited the provision of additional evidence before the Court of Appeal only without other courts.As a right of the appellate parties, and as a result, we asked him to open the door to provide them in a broader manner according to the controls that ensure the seriousness of the matter and in this regard we asked about the extent of the right of the interference and entry in the stage of first degree to submit additional evidence before the Court of Appeal.We concluded that the term " appellate parties ", which the legislator preferred to use in this regard, could be interpreted so broadly that anyone who could present evidence before the Court of First Instance and satisfied the conditions for the submission of additional evidence before the Court of Appeal could submit it.,
