Abstract EN

This study examined the effect of the wife’s imprisonment on some of her marital rights in the dowry, whether after marriage or before, with true privacy, or without.

It also examined the effect on alimony in the event of the wife’s imprisonment, whether the plaintiff is the husband himself or a foreigner.

To this is added the examination of the effect of the wife’s imprisonment’s on her right to custody.

This study is a comparison between Islamic jurisprudence and the Emirati Personal Status Law.

The problem it revolves around consists in answering several questions, including the extent to which the wife’s imprisonment’s has an effect on her right to dowry, alimony, and custody of her child.

The study reached several results, including the following: (1) the wife's imprisonment does not affect her right to dowry, whether divorced after intercourse or before; (2) the wife’s imprisonment has an effect on her right to alimony in case the plaintiff is not her husband; and (3) she loses her right to custody, as a result of her inability to take care of the child.
