Abstract EN
The new leave is one of the newly organized legal concepts, as it should have been behind it to achieve certain purposes; Thus, this research aims to identify the effects of granting the new leave and explain it in detail in terms of its impact vis a vis the employee who enjoys it; To find out the extent of its impact in relation to employee's rights and obligations, in addition to indicating its impact in relation to the public utility, whether in terms of its impact on the administration in the performance of its tasks, or in terms of its impact on the employee who does not enjoy it or the local people who deal with the public utility, and thus the nature of the study requires following the analytical method; In order to find and analyze the texts attached to it.
The study concluded with a set of results and proposals, the most prominent of which is that the effects of the newly created leave incompatible with the principles of equality and equal opportunities stipulated in the constitution, in addition to their conflict and the general origin in the civil service laws, whereas according to the laws of the service, the salary is due to the public employee by undertaking the job work and the tasks assigned to him.
The enjoyment of the newly created leave has multiple effects, some of which are related to the employee enjoying it, including those related to the public facility.
As for the most prominent proposals, to invite the administration to issue internal controls that are permanent and stable, not temporary, to be changed annually, in line with the nature of its work and the activity specified for leave legally in light of its owners Authentically approved, in a way that contributes to the widening of the positive effects and addressing the negative effects in order to achieve the purpose of the new leave legislation.
